ArtBidHere

Terms of service

In force since 12 October 2026

What you are contracting for

ArtBidHere is a trade name of Luyten Gallery, S.L. (Spanish tax number B21619937). Using the service as a seller contracts access to software that collects offers for your artworks wherever you show them: on your Instagram, on the wall at a fair or exhibition, or on your website.

You are not contracting a sale, an auction service, or payment intermediation. No money for the artwork passes through this platform at any point: no price, no deposit, no commission. We charge a flat fee for the software; what happens to the artwork is between you and the buyer.

You are the seller

To whoever bids, you are the seller, not ArtBidHere. That means:

  • You warrant that you have the right to offer every artwork you publish.
  • You are answerable for the description, authorship, year, medium and dimensions being correct.
  • You are answerable for your own legal, tax and invoicing obligations towards the buyer.
  • If you sell to consumers, it is you who must comply with the consumer law that applies to you.

Your public name appears on every label and every artwork page. It is required: nobody should have to guess who they are offering money to.

Credits and price

The service runs on credits. One credit prepares one artwork: its bidding page, its link, its QR code, its label, its story and post images for Instagram, and a bidding of a few hours, seven days or up to 90 days.

  • 5 credits — 10
  • 15 credits — 25
  • 40 credits — 50

Charged in euros, pounds or dollars depending on your country, always the same figure. Prices are final and identical worldwide: what you see is what you pay. Any applicable tax is included in that figure. If you are an EU business with a valid VAT number, the reverse charge applies and the price does not change.

Credits expire 12 months after purchase. We email you 30 days beforehand.

Every label, and every story or post image we give you, carries a small "Powered by ArtBidHere". If you buy a 40-credit pack, you can take it off. That option does not expire with the pack's credits, and is withdrawn if the pack is refunded.

Payment is taken through Stripe. We never see or store your card number.

Preparing, starting and close

Each artwork is prepared separately, and preparing is what consumes the credit: from that moment its QR code resolves and its label can be printed, with no clock running. These terms are accepted at that step, because it is the one that spends the money.

Starting the bidding is free and you do it whenever you choose — a minute later or three weeks later, with the label already on the wall or the story ready to post. When you prepare the artwork you choose its duration: between 1 and 72 hours or, as a long run, between 4 and 90 whole days; the clock starts when you start the bidding, and from that moment the closing time is immutable: you cannot change it and neither can we. That promise is what makes the bidding credible to somebody offering money.

An artwork that did not sell can be reopened on the same QR and the same link: it returns to draft, you can correct its price, and preparing it again consumes another credit. The previous round's offers and contacts are kept.

If bidding reaches its closing time without having received any bid, even if it was paused, the credit it consumed comes back to your balance at that moment: to the pack it came from, with that pack's expiry, or valid for 30 days from the close if that pack had less left or had already expired. The same goes for the free credit of your first artwork. It does not come back if there was at least one bid, even one you voided, if you withdraw the artwork, if we suspend or cancel its bidding, or if a prepared artwork is never started. It comes back as a credit, not as money.

Besides the starting bid you may set a close-now price: optional, at no extra cost, and at least a third above the starting bid. If somebody offers exactly that amount while it is available, their offer is an offer to buy like the others — with the same verified details — and the artwork closes at that moment, before its closing time, with that offer as the highest and its hour of priority. It stops being available, and does not come back in that round, once the leading offer reaches 75% of that price or the next minimum bid exceeds it. You change it freely before you start the bidding; once bidding is open you can only remove it, never set or change it. A reopened artwork starts without one. An artwork closed this way has received an offer, so its credit does not come back. It is the only way an artwork closes before its time; the closing time itself does not move.

While an artwork is live you can pause it — it stops taking new offers, the existing ones stand and the clock keeps running — and you can withdraw it, which voids every offer and notifies every bidder. Withdrawal is irreversible and does not return the credit.

You see each bidder's email and phone number from the moment their offer is recorded, while bidding is still open, and at close you have all of them on screen and in an exportable file: you paid for them and they are yours from the first moment, with no waiting. The phone number is typed by the bidder and we do not verify it. Bidders know all of this before they bid: their terms and the form itself tell them.

With them comes one obligation, and it is the only thing we ask of you about how you treat bidders: the highest offer has one hour of priority from the moment the close is announced to them by email, not from the closing time. During that hour you approach that person first. After it, you may talk to whoever you like. We promise them this in their own terms and you keep it: we remind you on screen, we do not stop you.

What you may not publish

You may not use the service for artworks you have no right to sell, for unlawful content or content infringing third-party rights, or to simulate offers or bid on your own works.

If we detect such use we may suspend public access to your artworks or cancel their bidding. We will tell you in writing and explain why.

Refunds

The full terms are in the Refund policy. In short:

  • If preparing an artwork fails through a technical problem of ours, **the credit is returned

automatically**.

  • If an artwork's bidding closes with no bids, its credit comes back to your balance as a

credit.

  • A pack is refunded in full if you have not prepared any artwork with it. A pack you have

prepared an artwork with counts as used even if the credit came back, and is no longer refunded in money.

  • A consumed credit is not refunded in money, even if you withdraw the artwork: the service was

provided.

If you are contracting as a consumer, you have 14 calendar days to withdraw. By preparing an artwork you expressly ask us to begin performance immediately and acknowledge that, once fully performed, you lose the right of withdrawal as to that part (article 103.a of Spanish Royal Legislative Decree 1/2007). For credits still unconsumed the right remains, and our refund policy is broader than the legal minimum.

Your workspace and your data

Your workspace is identified by an email address. You sign in with your password — or with Google or Apple, where offered; a six-digit code sent to that address verifies it when the account is created and is how you get back in if you forget the password. You can change the address from your account: the code goes to the new address and we notify the old one.

We keep your artworks and their results for as long as your account exists. Nothing is deleted on a timer, and we will not close a dormant account without writing to you first. You can delete the account yourself at any time, from the account screen: that erases the workspace, its artworks, its images and the bidders' contact details inside it, at once and for good. The detail is in the Privacy policy.

Because we keep it rather than expire it, two duties are yours. Keep the address on the account reachable — it is how we reach you and how you get back in. And treat what is stored here as a working record, not as your only copy: export the contacts you need, as you would from any other supplier.

The bidders' contact details you receive are third parties' personal data. On receiving them you become a controller of that data and undertake to use it only to deal with the sale of that artwork, not to pass it on, and not to use it for marketing without a legal basis of your own.

Availability and liability

We take reasonable steps to keep the service available, but do not guarantee uninterrupted operation. We are not answerable for failures of the network, of your device, or of the connection at the venue where you exhibit.

Our liability for the service is limited, save where the law does not permit limitation, to the amount you have paid in the preceding 12 months. We are not answerable for commercial outcomes: whether an artwork receives offers, whether a sale completes, or whether a buyer performs is not within our control.

Changes

We may change these terms. Where a change is substantial we will tell you before it applies. Artworks already prepared are governed by the version accepted when they were prepared.

Governing law and complaints

Spanish law applies. If you contract as a consumer you may bring proceedings before the courts of your own domicile and keep all your rights.

For any complaint use the contact form. We answer in writing.
