What this service is
ArtBidHere is software that lets a gallery or an artist collect offers for their artworks. Each artwork gets its own bidding page, and the seller takes it to their audience: as a story on their Instagram, as a wall label with a QR code beside the artwork at a fair or an exhibition, or as a box on their own website. Whoever sees it makes an offer from their phone.
This is not a public auction and not an auction house. No auctioneer takes part, the seller is not bound to sell to the highest bidder, and ArtBidHere awards nothing to anyone. What the service does is collect offers and, at close, introduce the seller to whoever made the highest one. If a sale follows, the two of them agree it directly.
No money for the artwork passes through this platform. No price, no deposit, no escrow, no commission. The only thing ArtBidHere charges is a flat fee to the seller for using the software, set out in the Terms of service.
Using the site
By using this site you agree to do so lawfully and in accordance with these terms, and not to use it for unlawful purposes, to damage the service, or to access other people's data.
Access to the site is free. Seller features require creating an account with a verified email address and accepting the Terms of service. Bidding requires verifying an email address, giving a phone number and accepting the Bidder terms.
Intellectual property
The software, design, text and presentation of this site belong to Luyten Gallery, S.L. or are used with the necessary permission.
Artwork images and details belong to whoever publishes them. Each seller keeps ownership of what they upload and is responsible for having the right to publish it. By publishing an artwork, the seller authorises ArtBidHere to display it on that artwork's public page, on its wall label and on the story and post images prepared for the seller, only for as long as the service and its retention period require.
Liability
ArtBidHere provides software. It is not a party to the sale of any artwork, does not warrant the authenticity, condition, provenance or ownership of published works, and is not answerable for what a seller and a buyer agree between them.
Luyten Gallery, S.L. is answerable for the provision of the service itself under the law and its terms, and excludes no liability that the law does not permit to be excluded, in particular towards consumers.
This site may link to third-party services — the payment gateway, for instance — whose terms and policies are their own.
Governing law and jurisdiction
These terms are governed by Spanish law.
If you are a consumer, any dispute may be brought before the courts of your own domicile, and you keep every right consumer law gives you. Otherwise, the parties submit to the courts of the registered office of Luyten Gallery, S.L.
